Your access to and use of this Website is conditional upon your acceptance of and compliance with these Terms. These Terms apply to everyone, including but not limited to visitors, users and others, who wish to access and use the Website.

Donations

When you make a donation on the Website, you will be using a third party payment processor, Stripe, that will collect your payment information and process your payment. We are not responsible for the collection, use, sharing or security of your billing information by Stripe. The following payment method(s) are accepted by the third party payment processor: American Express, check, Discover, MasterCard, Visa, and ApplePay, GooglePay.

You hereby represent and warrant that you have the legal right to use the payment method(s) in connection with any purchase and that the information that you supply to us and to the third party payment processor(s) is true, correct and complete.

Donation-specific Terms

Acceptance of any contribution, gift, or grant is at the discretion of the Omaha North High School Foundation (ONHSF). ONHSF will not accept any gift unless it can be used or expended consistently with the purpose and mission of ONHSF.No irrevocable gift, whether outright or life-income in character, will be accepted if, under any reasonable set of circumstances, the gift would jeopardize the donor’s financial security.

ONHSF will refrain from providing advice about the tax or other treatment of gifts and will encourage donors to seek guidance from their own professional advisers to assist them in making their donations.

ONHSF will accept donations of cash or publicly traded securities. Gifts of in-kind services will be accepted at the discretion of ONHSF. Certain other gifts, real property, personal property, in-kind gifts, non-liquid securities, and contributions whose sources are not transparent or whose use is restricted in some manner, must be reviewed prior to acceptance due to the special obligations raised or liabilities they may pose for ONHSF.

ONHSF will provide acknowledgments to donors meeting tax requirements for property received by the charity as a gift. However, except for gifts of cash and publicly traded securities, no value shall be ascribed to any receipt or other form of substantiation of a gift received by ONHSF.

ONHSF will respect the intent of the donor relating to gifts for restricted purposes and those relating to the desire to remain anonymous. With respect to anonymous gifts, ONHSF will restrict information about the donor to only those staff members with a need to know.

ONHSF will not compensate, whether through commissions, finders’ fees, or other means, any third party for directing a gift or a donor to ONHSF.

Recurring Donations

This Website features donation opportunities that are offered via a subscription model. A subscription model requires regular donations. The initial term of the recurring donation is 1 month.

You may revoke your recurring donation by contacting us within 14 days of making your recurring donation. If you revoke your recurring donation, it will not automatically renew and you will not be charged for the renewals. Please note that you will no longer receive the items or services provided by the recurring donation once you revoke it.

You must make a minimum donation to qualify for the recurring donation. The minimum recurring donation required is as follows: $20.

Automatic renewals of recurring donation

When you initiate a recurring donation on the Website, your recurring donation will automatically renew annually. We will automatically renew your recurring donation by using the payment method on file until you cancel your recurring donation.

The cancellation of the automatic renewal of your recurring donation will become effective immediately upon your contacting us.

Prohibited uses

Governing law, severability, dispute resolution, and venue

These Terms shall be governed and construed in accordance with the laws of the state of Nebraska, United States, without regard to its conflict of laws provisions. These terms shall not be governed by the United Nations Convention on contracts for the sale of international goods, the Uniform Commercial Code, nor Incoterms.
