Thank you for joining crew dogs! We are a military community of Active duty, Reservists, Guardsmen, Veterans, Retirees, and families members who stick together.

Please read this Terms of Service ("Terms," "Terms of Service") carefully before using the websites, applications, and other offerings from Crew dogs (collectively, the “Crew dogs Platform”) operated by Crew Dogs, LLC, a(n) Limited Liability Company formed in South Carolina, United States. When used in these Terms, "Crew dogs," "us," "we," "our" refers to the Crew dogs entity. These Terms of Service contain important information regarding the limitations of our liability. Your access to and use of the Crew dogs platform is conditional upon your acceptance of and compliance with these Terms. These Terms apply to everyone, including but not limited to visitors, guests, and hosts who wish to access and use Crew dogs.

The Crew dogs Platform offers an online venue that enables users (“Members”) to publish, offer, search for, and book services. Members who publish and offer services are “Hosts” and Members who search for, book, or use services are “Guests.” Hosts offer accommodations (“Accommodations”), and a variety of travel and other services (collectively, “Host Services,” and each Host Service offering, a “Listing”). You must register an account to access and use many features of the Crew dogs Platform, and must keep your account information accurate. As the provider of the Crew dogs Platform, Crew dogs does not own, control, offer or manage any Listings or Host Services. Crew dogs is not a party to the contracts entered into directly between Hosts and Guests, nor is Crew dogs a real estate broker, travel agency, or insurer. Crew dogs is not acting as an agent in any capacity for any Member, including payment processing at this time.

By accessing or using the Crew dogs platform you agree to be bound by these Terms. If you disagree with any part of the Terms, then you do not have our permission to access or use Crew dogs.

This community is grounded by the bond of our military service, and while issues or disagreements may arise during the use of our platform, by joining you agree to resolve disputes through direct negotiations before seeking external mediation by Crew dogs.

If you are a Host, you are responsible for understanding and complying with all laws, rules, regulations and contracts with third parties that apply to your Host Services.

Accounts

When you create an account on our Platform, you guarantee that you are 18 years of age or older and that the information that you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Website.

You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our App, Website or a third party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

We reserve the right to terminate your account anytime at our sole discretion. You can terminate your account by contacting us or through their account on the App or Website.

Comments and uploading content

By submitting a comment or uploading content onto this App or Website, you grant Crew Dogs, LLC a worldwide, non-exclusive, perpetual, royalty-free license to reproduce, publish and distribute the comment or content. When you make a comment or upload any content onto this App or Website, you agree that such comment or content may be viewed by other parties and it is your responsibility to ensure that the comment or content does not contain any confidential or proprietary information. You are also responsible for ensuring that your content or comment does not violate any laws, rules or regulations. We reserve the right to remove any content or comment at any time in our sole discretion.

The following is a non-exhaustive list of types of content or comments that you are prohibited from posting on our App or Website:

• Content that harasses others;
• Content that is discriminatory or offensive;
• Swearing, name calling and otherwise abusive content;
• Pornographic and sexually explicit content;
• Content displaying, depicting or suggesting violence;
• Content that exploits or abuses children;
• Content encouraging or committing illegal acts;
• Content sharing personal information without consent;
• Content infringing on someone’s rights, including intellectual property rights;
• Content advertising products or services without our permission;
• Content whose purpose is spamming others.

Crew dogs platform rules

You must follow these rules and must not help or induce others to break or circumvent these rules.

• Act with integrity and treat others with the respect and dignity that our military service and affiliation demands.
• Attempt to resolve disputes through direct negotiation before seeking alternative mediation by Crew dogs
• Do not lie, misrepresent something or someone, or pretend to be someone else.
• Be polite and respectful when you communicate or interact with others.
• Do not discriminate against or harass others.
• Do not scrape, hack, reverse engineer, compromise or impair the Crew dogs Platform.
• Do not use bots, crawlers, scrapers, or other automated means to access or collect data or other content from or otherwise interact with the Crew dogs Platform
• Do not hack, avoid, remove, impair, or otherwise attempt to circumvent any security or technological measure used to protect the Crew dogs Platform or Content.
• Do not decipher, decompile, disassemble, or reverse engineer any of the software or hardware used to provide the Crew dogs Platform.
• Do not take any action that could damage or adversely affect the performance or proper functioning of the Crew dogs Platform.
• Only use the Crew dogs Platform as authorized by these Terms or another agreement with us.
• You may only use another Member’s personal information as necessary to facilitate a transaction using the Crew dogs Platform as authorized by these Terms.
• Do not use the Crew dogs Platform, our messaging tools, or Members’ personal information to send commercial messages without the recipient’s express consent.
• You may use Content made available through the Crew dogs Platform solely as necessary to enable your use of the Crew dogs Platform as a Guest or Host.
• Do not use Content unless you have permission from the Content owner or the use is authorized by us in these Terms or another agreement you have with us.
• Do not require or encourage Guests to open an account, leave a review, complete a survey, or otherwise interact, with a third party website, application or service before, during or after a Reservation, unless authorized by Crew dogs.
• Do not engage in any practices that are intended to manipulate our search algorithm.
• Do not use, copy, display, mirror or frame the Crew dogs Platform, any Content, any Crew dogs branding, or any page layout or design without our consent.
• Honor your legal obligations. Understand and follow the laws that apply to you, including privacy, data protection, and export laws.
• If you provide us with someone else’s personal information, you: (i) must do so in compliance with applicable law, (ii) must be authorized to do so, and (iii) authorize us to process that information under our Privacy Policy.
• Do not organize or facilitate unauthorized parties or events. You are responsible and liable for any party or event during your Reservation that violates our rules for parties and events, as incorporated by reference herein.
• Do not use the name, logo, branding, or trademarks of Crew dogs or others without permission, and only as set forth in our Trademark Guidelines.
• Do not use or register any domain name, social media handle, trade name, trademark, branding, logo, or other source identifier that may be confused with Crew dogs branding.
• Do not offer Host Services that violate the laws or agreements that apply to you.
• Do not offer or solicit prostitution or participate in or facilitate human trafficking.

No warranty on App or Website

This App and Website is provided “as is,” No warranty, express or implied (including any implied warranty of merchantability, of satisfactory quality or fitness for a particular purpose or use) shall apply to this App and Website, whether arising by law, course of dealing, course of performance, usage of trade or otherwise.

Availability, errors and inaccuracies

We assume no liability for the availability, errors or inaccuracies of the information, products or services provided on this App or Website. We may experience delays in updating information on this App or Website and in our advertising on other websites. The information, products and services found on the Website may contain errors or inaccuracies or may not be complete or current. Products or services may be incorrectly priced or unavailable. We expressly reserve the right to correct any pricing errors on our App or Website. The inclusion or offering of any product or service on this App or Website does not constitute an endorsement or recommendation of such product or service by us.

Damages and limitation of liability

Neither Crew dogs (including its affiliates and personnel) nor any other party involved in creating, producing, or delivering the Crew dogs Platform or any Content will be liable for any incidental, special, exemplary or consequential damages, including lost profits, loss of data or loss of goodwill, service interruption, computer damage or system failure or the cost of substitute products or services, or for any damages for personal or bodily injury or emotional distress arising out of or in connection with (i) these Terms, (ii) the use of or inability to use the Crew dogs Platform or any Content, (iii) any communications, interactions or meetings you may have with someone you interact or meet with through, or as a result of, your use of the Crew dogs Platform, or (iv) publishing or booking of a Listing, including the provision or use of Host Services, whether based on warranty, contract, tort (including negligence), product liability or any other legal theory, and whether or not Crew dogs has been informed of the possibility of such damage, even if a limited remedy set out in these Terms is found to have failed of its essential purpose.

In no event will Crew dogs’s aggregate liability for any claim or dispute arising out of or in connection with these Terms, your interaction with any Members, or your use of or inability to use the Crew dogs Platform, any Content, or any Host Service, exceed: (A) to Guests, the amount you paid as a Guest during the 12-month period prior to the event giving rise to the liability, (B) to Hosts, the amount paid to you as a Host in the 12-month period prior to the event giving rise to the liability, or (C) to anyone else, one hundred U.S. dollars (US$100).

These limitations of liability and damages are fundamental elements of the agreement between you and Crew dogs. If applicable law does not allow the limitations of liability set out in these Terms, the above limitations may not apply to you.

Indemnification

To the maximum extent permitted by applicable law, you agree to release, defend (at Crew dogs’s option), indemnify, and hold Crew dogs harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with: (i) your breach of these Terms, (ii) your improper use of the Crew dogs Platform, (iii) your interaction with any Member, stay at an Accommodation, or other Host Service, including without limitation any injuries, losses or damages (whether compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of such interaction, stay, participation or use, (iv) your failure, or our failure at your direction, to accurately report, collect or remit Taxes, or (v) your breach of any laws, regulations or third party rights such as intellectual property or privacy rights.

Unless specified otherwise, this Website and all content and other materials on this App and Website including but not limited to all logos, designs, text, graphics, pictures, information, data, software, sound files and arrangement thereof (collectively, “Content”) are the proprietary property of Crew Dogs, LLC and are either registered trademarks, trademarks or otherwise protected intellectual property of Crew Dogs, LLC or third parties in the United States and/or other countries.

If you are aware of a potential infringement of our intellectual property, please contact Support Staff at support@crewdogs.com.

We respect the intellectual property rights of others. It is our policy to respond to any claim that Content posted on the App or Website infringes on the copyright, trademark or other intellectual property rights of any person or entity.

If you believe in good faith that the Content infringes on your intellectual property rights, you or your agent may send us a written notice of such infringement titled “Infringement of Intellectual Property Rights - DMCA.” Your notice to us must include the following information:

1. An electronic or physical signature of the person authorized to act on behalf of the owner of the intellectual property right’s interest;
2. A description of the work that you claim has been infringed, including the URL (i.e., web page address) of the location where the work exists or a copy of the work;
3. Your name, email, address and telephone number; and
4. A statement by you that you have a good faith belief that the disputed use is not authorized by the owner of the work, its agent or the law.

Please note that we will not process your complaint if it is not properly filled out or is incomplete. You may be held accountable for damages, including but not limited to costs and attorneys’ fees for any misrepresentation or bad faith claims regarding the infringement of your intellectual property rights by the Content on this App and Website.

Governing law, severability, dispute resolution and venue

These Terms shall be governed and construed in accordance with the laws of the state of South Carolina, United States, without regard to its conflict of laws provisions. These terms shall not be governed by the United Nations convention on contracts for the sale of international goods, the Uniform Commercial Code, nor Incoterms.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between you and us regarding our App and Website, and supersede and replace any prior agreements we might have had with you regarding the App or Website.

Any controversy or claim arising out of or relating to these Terms including but not limited to the interpretation or breach thereof shall be resolved in a court of competent jurisdiction in United States County, South Carolina.

You and Crew Dogs, LLC agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any class or representative action.

Changes to Terms of Service

We reserve the right to make changes to these Terms of Service at any time. We will notify you immediately of making any changes to these Terms of Service via by posting the updated terms of service to this app and website.
